SECTION 2 — COACHING TERMS OF SERVICE & CANCELLATION POLICY

TERMS OF SERVICE & CANCELLATION POLICY

1.    AGREEMENT TO TERMS

By enrolling in, accessing, or using any program, service, coaching, or materials provided by Body Transformation Lab Co. (“Company,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms.

2.    PROGRAM DESCRIPTION

We provide online coaching, nutritional guidance, exercise programming, accountability check-ins, and proprietary educational resources via Trainerize, online calls, and downloadable materials.

Access to intellectual property (meal plans, frameworks, workouts, PDFs, software, etc.) begins immediately upon purchase.

Results depend on adherence and participation; individual outcomes vary.

3.    PAYMENT TERMS

• All payments are due in full at enrollment, whether paid upfront or through a third-party provider (Affirm, Klarna, Stripe).

• If you use a financing provider, you enter a separate agreement with that provider and remain fully responsible for repayment regardless of participation or outcome.

• Failure to make timely payments may result in suspension or termination of access. The Company reserves the right to seek recovery of unpaid balances through appropriate lawful means.

 4.    REFUND POLICY (FTC & Processor Compliant)

Refund requests are evaluated under Body Transformation Lab Co.’s internal compliance policy consistent with Federal Trade Commission (FTC) digital-commerce guidelines and industry best practices. All refund determinations are handled transparently and fairly, with documentation retained for verification by payment processors, financing partners, or banking institutions if required.

Body Transformation Lab Co. can accept refunds of products or services purchased directly from Body Transformation Lab Co. and only within the restrictions below. Processing may require up to two weeks once all information is received.

1:1 Coaching Program

We invest heavily in your success by hiring specialty coaches, trainers, and support staff. In return, we expect full commitment from you.

We stand behind your results with our Body Transformation Lab Double Assurance Program.

What is the Double Assurance Program?

If you complete the entire program exactly as advised and do not experience measurable results, we will:

Refund 100 % of the coaching fees you paid, and

Continue to coach you at no additional cost until results are achieved.

Eligibility requires verified adherence to all prescribed program tasks and plans. Disengagement or non-compliance voids eligibility.

Refunds, if granted, are processed within 10–14 business days after review of compliance.

Refunds are not provided for dissatisfaction, change of mind, or non-participation.

5.    CANCELLATION POLICY

Cancellations are not permitted once onboarding has occurred.

Onboarding occurs when any of the following take place:

• Client is granted Trainerize access; or

• Client attends or is offered a Nutrition Orientation call; or

• Client receives any proprietary material (meal plan, framework, workout, resource).

Upon onboarding, Client gains immediate access to proprietary materials and intellectual property, constituting full or partial delivery of services under digital-product laws.

Because onboarding includes delivery of digital intellectual property and program access, all payments become non-refundable once onboarding has occurred.

6.    CLIENT RESPONSIBILITIES

Client agrees to: provide accurate information, consult a physician before starting, follow guidelines and recommendations, use Company apps in good faith, and not distribute proprietary materials.

7.    DISCLAIMER OF WARRANTIES

We are not medical providers and do not offer medical advice, diagnosis, or treatment. All content is educational. No specific results are guaranteed. Testimonials are illustrative only.

8.    LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company is not liable for any direct or indirect damages arising from participation. Client releases and holds harmless the Company and its representatives from any related claims.

9.    INTELLECTUAL PROPERTY

All materials supplied remain the intellectual property of Body Transformation Lab Co. License is limited to personal use only; redistribution or resale is strictly prohibited.

10.    TERMINATION

We may terminate access without refund for: harassment or abuse of staff, breach of Terms, or unauthorized distribution of intellectual property.

11.    GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the Commonwealth of Pennsylvania. All disputes shall be submitted to confidential, binding arbitration in Westmoreland County, PA, under the rules of the American Arbitration Association.

This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1–16).

The prevailing party may recover reasonable attorney’s fees and costs.

Clients agree to refrain from posting false or defamatory statements about the Company or its representatives; constructive feedback should be directed privately.

12.    DISPUTE MISUSE & REPUTATIONAL DAMAGE

Initiating a chargeback or financing dispute under false pretenses constitutes a material breach of this Agreement.

The Company may provide proof of access logs, communications, and digital delivery to financing partners or authorities as needed.

Verified acts of defamation or dispute abuse may be referred to legal counsel for review and potential recovery of damages.

13.    DIGITAL ACCEPTANCE

Electronic acceptance (via checkout, email confirmation, or digital signature) constitutes a binding agreement equal to a physical signature.

14.    ENTIRE AGREEMENT

These Terms represent the entire agreement between Client and Company and supersede all prior understandings. Updates may be posted at any time.

15.    ACKNOWLEDGEMENT

By enrolling, Client acknowledges reading, understanding, and agreeing to these Terms, the Refund Policy, and the Cancellation Policy.

SECTION 3 — ACCEPTANCE AND LEGAL EFFECT

By accessing this website or enrolling in a Body Transformation Lab program, you agree that both the Website and Coaching Terms collectively form the binding Terms of Service between you and Body Transformation Lab Co.

Your continued use constitutes full and informed consent to all terms contained herein.
